GENERAL PURPOSE


Assist the General Counsel and Deputy General Counsel in providing legal advice and representation to the Governing Board, Executive Director, Deputy Executive Director and their staff on a variety of matters affecting the South Florida Regional Transportation Authority ("SFRTA").


ESSENTIAL FUNCTIONS

  • Assist the General Counsel and Deputy General Counsel with supervision of outside law firms that represent SFRTA, including coordinating and monitoring services provided by outside counsel.
  • Assist General Counsel and Deputy General Counsel with providing counsel and advice on legal matters to the Governing Board, Executive Director, Deputy Executive Director and their staff.
  • Draft various legal documents, including policies, resolutions, contracts, leases, legislation, briefs, memoranda and motions.
  • Assist General Counsel and Deputy General Counsel with rendering routine legal advice and opinions to the Governing Board, Executive Director, Deputy Executive Director and their staff as required; conduct on-going legal research of federal and State laws and regulations in connection with legal issues pertaining to SFRTA; prepare oral and written legal opinions.
  • Answer questions and provide information of a legal nature to other public agencies (federal, State, county, municipal and special districts) regarding SFRTA operations, projects, policies and procedures.
  • Coordinate efforts of agency staff in resolving and responding to legal matters.
  • Review, analyze and draft State and federal legislation and rules pertaining to SFRTA.
  • Appear before courts and administrative proceedings to represent the SFRTA's interest as required; prosecute or defend assigned suits instituted by or against the SFRTA.
  • Review SFRTA-related documents as to legal form and sufficiency.
  • Perform legal review of real estate matters and activities of SFRTA.
  • Provide legal advice, review, support and protection of SFRTA assets.
  • Assist the General Counsel and Deputy General Counsel with planning, developing and overseeing implementation of long and short-range strategies and programs for the Legal Department.
  • At the request of the General Counsel or Deputy General Counsel, may make recommendations and presentations to the Governing Board on matters pertaining to legal services and risk management.
  • Assist the General Counsel and Deputy General Counsel in coordinating with Florida Department of Transportation (FDOT) and attorneys assigned by FDOT to represent SFRTA or its contractors in the handling of liability claims to which SFRTA or its contractors are a party.
  • Assist the General Counsel and Deputy General Counsel in analyzing liability claims and insurance policies to determine the extent and limits of coverage.

  • Knowledge of organization, powers, duties and limitations of SFRTA as a legal entity created pursuant to State law.
  • Knowledge of federal and State laws and regulations and legal precedents applicable to SFRTA’s activities.
  • Knowledge of transactional and local government law including including the areas of local and State government revenues, procurement, and contract drafting.
  • Ability to present statements of law, fact, and argument clearly and logically.
  • Ability to apply skills and concepts involved in problem solving, including identifying and diagnosing the problem, generating alternative solutions and strategies, implementing the plan, and keeping the planning process open to new information and new ideas.
  • Knowledge of the State of Florida’s Public Records Law, Sunshine Law and ethics laws applicable to public employees and officials and ability to advise SFRTA regarding same.
  • Ability to apply the skills and concepts involved in legal analysis and reasoning, including identifying and formulating legal issues, and formulating and evaluating legal theories.
  • Ability to conduct research on legal problems and prepare sound legal opinions, including applying legal rules, using fundamental tools of legal research.
  • Ability to evaluate the likely practical consequences of given legal strategies.
  • Ability to apply the skills and concepts involved in factual investigation, including determining the need for factual investigation, planning a factual investigation, implementing the investigative strategy, collecting, organizing  and memorializing information in an accessible form, evaluating the information that has been gathered and formulating recommendations.
  • Having the necessary skills and abilities to negotiate complex transactions.
  • Ability to exercise good judgment, flexibility, creativity, and sensitivity in response to changing situations and needs.

COMPUTER EQUIPMENT AND SOFTWARE REQUIREMENTS

  • Ability to work with a personal computer in a Windows environment.  
  • Proficient in Word, Excel, Outlook, PowerPoint and either Lexis or Westlaw.


MINIMUM EDUCATION & EXPERIENCE


Education

  • Juris doctor law degree from an ABA-accredited law school.  


Experience

  • Minimum of four (4) years’ experience practicing law in the State of Florida.  

  • Admitted and in good standing with the Florida Bar during employment. 

  • Government experience in the transportation field, complex transactions involving governmental entities, public finance, litigation, real estate, personnel matters or any combination of these subjects is highly desirable. 


LANGUAGE SKILLS

  • Ability to read, analyze, and interpret scientific and technical journals, financial reports, and legal documents. 

  • Ability to apply principles of logical thinking to a wide range of intellectual and practical problems.  

  • Ability to respond to inquiries or complaints from customers, regulatory agencies, or members of the business community.  

  • Ability to write speeches and articles for publication that conform to prescribed style and format.  

  • Ability to effectively present information to top management, public groups, and/or boards of directors.


CERTIFICATES, LICENSES & REGISTRATIONS

  • Must be a member, in good standing, of the Florida Bar.
